Butler man arrested, charged with aggravated assault, resisting arrest, DUI

A Butler man is facing charges after allegedly resisting officers during an arrest for possible DUI on Monday night, Feb. 16.

Logan R. Maher, 29, has been charged with two felony counts of aggravated assault and a felony count of escape; two misdemeanor counts each of resisting arrest and DUI and a misdemeanor count of disorderly conduct, as well as three summary offenses.

According to an affidavit in the case, Adams Township police first received a report on Monday night of a white Volkswagen driving erratically on Route 228 without its lights on. An officer later identified the vehicle based on the license plate number the witness provided and allegedly saw it swerving erratically while driving eastbound.

After he was pulled over, the affidavit states, Maher had trouble locating his wallet, and was “unsteady” while stepping out of his vehicle. He also displayed several outward signs of intoxication, such as bloodshot eyes and the smell of alcohol on his breath.

According to police, when asked to walk to a patrol vehicle, Maher became argumentative and was placed under arrest. While officers attempted to place him in handcuffs, Maher began physically resisting. According to police, after he was handcuffed, Maher continued to resist officers’ efforts to put him into a police car.

According to the affidavit, Maher refused a breath test.

According to police, Maher was taken to the Adams Township police station, where he destroyed a roll of toilet paper and was disruptive. Police said he was placed in a transport belt and restraint device to move him to Butler County Prison, during which time he continued to resist officers.

According to the affidavit, Maher refused to answer to the prison nurse, requiring he be transported to Butler Memorial Hospital for medical clearance required for placement in the county jail. According to the affidavit, Maher continued to resist at the hospital by screaming and yelling in the lobby and refusing to stay seated.

Police said officers removed him from the hospital to place him back into a police car, during which time he continued to resist and a physical altercation ensued in which Maher broke free and managed to exit the vehicle and attempted to flee before he was stopped by a Taser. Maher was eventually restrained on a medical gurney and chemically sedated by hospital staff, according to the affidavit.

Maher is confined to Butler County Prison on $25,000 bail.

His preliminary hearing is scheduled for Feb. 25 in front of District Judge Amy Marcinkiewicz.
