Butler County bicyclist getting summary trial

A Connoquenessing Township man’s second fight to be allowed to ride his bicycle on roads without having to pull over to let faster motor vehicles pass is underway.

Brendan A. Linton, 30, is facing a summary charge of pedal cycle operated at safe speed to not impede traffic. Under that section of the state Traffic Code, a pedal cycle may be operated at a safe and reasonable speed appropriate for the pedal cycle. However, a pedal cycle operator shall use reasonable efforts so as not to impede the normal and reasonable movement of traffic.

State police charged Linton with that summary count, a second summary violation for a slow moving vehicle impeding traffic count and for not pulling off the road, and a misdemeanor charge of disorderly conduct, following a traffic stop on Oct. 25, 2022, on Route 68 in Butler Township.

At a Butler County Common Pleas Court hearing Friday, Oct. 31, the second summary charge and the disorderly conduct charge were withdrawn by the district attorney’s office.

“It was a good day,” Linton’s attorney, Corrie Woods, said after the hearing.

A trial on the remaining summary charge will be scheduled, he said.

It is the same charge Linton was convicted of at a summary trial following a July 31, 2021, traffic stop on the same road, but in Connoquenessing Township.

Linton appealed the conviction to state Superior Court, which upheld the verdict. He appealed that ruling to the state Supreme Court, which accepted the appeal and remanded the case back to Superior Court, where it is pending further action.
