Adams Twp. takes the next step toward data center amendment

ADAMS TWP — The township’s board of supervisors voted unanimously to approve a 180-day moratorium on six types of businesses during its Monday, July 13, meeting.

The businesses are data centers, power generation plants, large-scale and accessory solar power systems, last mile fulfillment centers, micro-warehouses, and dispensaries.

Current zoning ordinances do not address these businesses, allowing anyone to walk in and build one of these six types of businesses anywhere within the township, township solicitor Mike Gallagher said.

The resolution was a follow-up to a motion made at the June 22 meeting to establish a moratorium and allows the township up to 180 days to draft a “curative amendment” to the township’s zoning ordinance.

The resolution states the exclusion, for the time being, “does not bear a substantial relationship to the public health, safety or morals of residents of, or visitors to, Adams Township.”

Additionally, a sweeping ban on these businesses “cannot pass constitutional muster” as per the resolution, and is therefore invalid.

The amendment being prepared seeks to “correct the declared invalidity.”

At the June 22 meeting, board chairman Russell Ford had referred to the moratorium as a preemptive measure, rather than one in response to any actual zoning application.

At the end of the meeting, Ford reminded attendees that the fourth Mars borough and Adams Township joint merger meeting will be held at 6 p.m. July 28 at the Adams Township Municipal Building.
